Saiful Helmi Bin Hussinin His Car Following His Acquittal

Today, the Magistrate’s Court here freed Saiful Helmi Bin Hussin from a drug possession charge.
The Accused was charged under Section 12 (2) of the Dangerous Drugs Act 1952, punishable under Section 39A (1) of the same Act.
In January 2020, police raided Saiful’s home and found him sitting on his porch. They escorted him towards the back of the house where they found a large house containing several large roosters.
The roosters were bred for cockfighting which the Accused claimed was his main source of income.
Further investigation of the area behind the cock house revealed a DHL bag in the bushes under a banana tree. Police opened the bag and discovered several red and green tablets.
Saiful Helmi was accused of possessing 27.09g of methamphetamine. It was submitted that the Accused had no knowledge, custody and control of the said drugs which was found about 23 meters away from his house, thus cannot be said to has possession of them.
The Defence also urged the Court to invoke adverse inference under Section 114(g) of Evidence Act 1950 against the Prosecution for failure to call at least 4 other material witnesses who may throw light as to the truth of what has been alleged against the Accused.
The Deputy Public Prosecutor in charge has changed three times throughout the case.
