BANGI – Varata Rajoo was all smiles as he walked out of the courtroom today, having been acquitted and discharged of all three (3) charges for drugs possession by the Bangi Sessions Court Judge, Tuan Shahrul Rizal Bin Majid. Varata was acquitted at the end of Prosecution’s case, without defence being called. 4 prosecution witnesses were called to testify in this case.
The Accused was arrested on 23rd October 2021 in front of a shop lot in Bandar Rinching, Semenyih whereby drugs were allegedly found in the pocket of the shorts worn by the Accused. He was charged under Section 39A(1) and Section 39A(2) of the Dangerous Drugs Act 1952.
Lead counsel, Dato’ Geethan Ram Vincent who was assisted by Shanmathi submitted that the Prosecution has failed to prove the element of possession and knowledge of the Accused in this case. Among others, he pointed out that there exists a real doubt in relation to the actual place the drugs were found. This doubt was amplified especially when there were glaring and material discrepancies in the testimonies given by the Prosecution witnesses in this case.
