New Counsel Spearheads Successful Reversal of Attempted Murder Conviction

YA Datuk Meor Hashimi bin Abdul Hamid in the High Court here today set aside the conviction and sentence of Siva A/L Chandrasegaran, discharging him with immediate effect.
The Appellant was charged with attempted murder under Section 307 of the Penal Code read together with Section 34 of the same Act.
It was alleged that in 2014, Siva and four others attacked 19-year-old Prem Raj a/l Batmanathan.
The group allegedly slashed the victim’s head and chopped off his left arm.
6 prosecution witnesses and 2 defence witnesses were called in the trial.
On March 26, 2018, the Session’s Court judge found that Defence had failed to raise any reasonable doubtand proceeded to convict and sentence the Appellant to 18 years imprisonment.
Counsels Dato’ Geethan Ram Vincent and Lavanyia Raja were elected to represent Siva in this appeal.
Defence Counsels submitted 23 grounds of appeal in their Petition of Appeal.
His Lordship, in quashing the conviction against the Appellant said that, appellate intervention is necessary in this case where there has been a misdirection by the Learned Trial Judge. His Lordship agrees with Counsel’s submission that the Appellant hascast a reasonable doubt in the Prosecution case.
Siva walked out of Court 2 with a relived expression on his face.
He was first arrested on April 21, 2015.
