Anya Michael Onyedikachi was all smiles as he walked out of High Court 2 here today a free man after the judge found him not guilty.

He was charged under section 39B of the Dangerous Drugs Act 1952 for trafficking 104.65g of Methamphetamine, an offence which carries the mandatory death penalty.

The Prosecution allege that at 7:15pm on 30 November 2014, a police team led by ASP Anuar Bin Hj Md Azali @ Md Ghazali conducted surveillance at a Petron Sungai Besi on the KL-Seremban Highway. The
Accused was arrested and searched, whereupon police found a bunch of keys and one access card to a condominium in Bukit Damansara.

A plastic wrapper containing white crystals was found in the condominium. “This court is fully satisfied with the testimony of the Chemist regarding the analysis of such drugs” YA Haji Mohamad Shariff bin Hj Abu
Samah was quoted stating.

10 witnesses took the stand.

The Court heard that there were 2 toothbrushes and 3 mattresses found in the condominium. Various witnesses also confirmed that there were several access cards and even a lift that did not require any validation or verification to use.

On this, the Honoruable Judge decided that he could not, beyond reasonable doubt, find that the Accused had possession or knowledge of the drugs. He further stated that “the Court is not prepared to convict the accused if he elects to remain silent”.

The Accused was discharged at the close of the Prosecution’s case.
